Minutes
Chairman Robert Harrington called the January 19, 2010
meeting of the Branford Zoning Board of Appeals to order at 7:00 p.m. to hear
the following applications. Also attending and voting were Lawrence Fisher,
James Sette, Alternates Frank Kinney, Joshua Brown and Christine Ciociola.
Excused: Anthony Beccia and David Laska.
1/10 - 1. David Falcigno,/Richard Falcigno, 247 Linden
Avenue: Granted 5/0. There was proof of hardship. FEMA regulations
require additional height. Applicant will be aligning deck to end of house
squaring it off and adding a second floor with minimal impact to the
environment so the Coastal Site Plan was also approved
1/10 - 2. Sandra Vlock/Glenn Arbonies, 2 and 3 Prospect
Hill Road (aka 306 Thimble Islands Road) and Coastal Site Plan Review: Continued
to February 16, 2010 at 6:30 pm with the same members sitting. There were
many in opposition who spoke to the scope and style of the project and some had
the wrong idea of where the street line was as defined in the regulations. As the
Board heard the application, questions concerning height were not answered and
that was a concern to the opposition as well, so it was decided to continue the
application to allow the applicant to gather and present that information,
however that is all that will be addressed at the February meeting and the
decision of the Board will follow.
1/10 - 3. Jean L. Farricelli, 104 Cherry Hill Road: Tabled
until February 16, 2010 at 7:00 pm at the request of the applicant. Anonymous
letter in file is not to be considered an exhibit.
1/10 - 4. Craig M. Whitehouse, 220 Pleasant Point Road: Granted
5/0. The improvements to the property including addition of shrubbery and
an improved septic system outweigh other considerations. The location of the
house and septic system, the topography of the land and the slope combined with
granite outcroppings make the area difficult to develop. Although there was
opposition by Atty. Peter Berdon, representing his father, the Board felt that,
since the accessory structures were some 16 ft. above view from the street,
there was no visual impact on the adjoining property owners. The proposed
greenhouse will be an excellent addition and although the pool might be
considered an extravagant accessory, it is his right to install one if he
wishes. Any amelioration of existing drainage problems should be addressed by
the parties and solutions sought by them in a friendly exchange.
1/10 - 5. Barry J. Morganti, 54 Elm Street: Granted 5/0.
Atty. Patterson representing. The area has developed into multi-family
houses and this is only creating one new 1 bedroom apartment to replace an
existing business.
1/10 -6. Imee Dasigan and Michael Willmott, 23 Silver
Street: Granted 5/0. The applicant is requesting a small addition and
will be removing an unsightly outside staircase. The property will be
less non-conforming when finished.
1/10 - 7. Christopher and Eleanor W. Nelson: Granted
5/0. The applicant received variances to improve the house, however once
renovations started it was discovered that there was considerable structural
damage and the entire house needed new construction. The new structure will be
rebuilt on the same footprint, although smaller and more conforming. The Board
believed they would have voted to allow these additional variances if they had
been sought to begin with.
